TERMS & CONDITIONS

Effective for the 2026 Hunting Season
These Terms and Conditions (“Agreement”) govern all hunting safaris, photographic safaris, and related outdoor activities conducted by Xumabee Game Ranch (“the Outfitter,” “we,” “us,” or “our”) in Botswana. By booking, paying a deposit, or participating in any activity, the client (“the Client,” “you,” or “participant”) acknowledges that they have read, understood, and agreed to be legally bound by this Agreement.

1. ASSUMPTION OF RISK

The Client expressly acknowledges that hunting and safari activities involve inherent and unpredictable risks, including but not limited to:
•Encounters with dangerous and unpredictable wildlife
•Use and handling of firearms and ammunition
•Travel over rugged, remote, and undeveloped terrain
•Extreme weather conditions
•Limited access to immediate medical care
•The Client voluntarily assumes all risks, whether known or unknown, inherent or incidental, associated with participation in any activity provided by the Outfitter.

2. RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted under the laws of Botswana, the Client hereby releases, waives, and discharges the Outfitter, its owners, directors, employees, professional hunters, guides, contractors, landowners, and agents from any and all claims, demands, actions, or causes of action arising out of or related to personal injury, death, property damage, or loss, including those resulting from ordinary negligence.
This waiver shall remain in full force and effect notwithstanding the termination or completion of the hunt.

3. INDEMNIFICATION AND HOLD HARMLESS

The Client agrees to indemnify, defend, and hold harmless the Outfitter and all associated parties from any claims, liabilities, damages, costs, or expenses (including legal fees) arising from:
• The Client’s participation in hunting or safari activities
• The Client’s violation of this Agreement
• The Client’s negligent or intentional acts

4. LEGAL COMPLIANCE AND LICENSING

The Client is solely responsible for obtaining and maintaining all valid 2026 hunting licenses, permits, firearm authorizations, and documentation required under Botswana law.
The Client agrees to comply fully with:
•All Botswana wildlife, conservation, and firearm laws
•Quota restrictions and species regulations
•Instructions from the Professional Hunter and staff
•Failure to comply may result in immediate termination of the hunt without refund.

5. FINANCIAL TERMS AND PAYMENT POLICY

5.1 Deposits To confirm any booking, a non-refundable deposit of 50% of the total invoiced amount is required. The remaining balance is payable in full upon arrival in Botswana, prior to any commencement of any activities. Booking dates may be transferred once, subject to availability, at an additional 10% date-change fee calculated on the total invoiced amount. Transferred bookings must be used within eight (8) months from the original invoice date. Failure to comply with these payment or date-change terms will result in forfeiture of the reservation and the full 50% deposit.
5.2 Final Payment The remaining 100% balance is due upon arrival, prior to the commencement of any hunting activity.
5.3 No Refunds Shall be issued for:
•Early departure or unused hunting days
•Poor weather conditions
•Failure to harvest or wound an animal
•Changes in personal circumstances

6. NO GUARANTEE OF SUCCESS

The Outfitter makes no guarantees, expressed or implied, regarding:
•Hunting success
•Trophy size or quality
•Animal availability or sightings
•Hunting success depends on wildlife behaviour, environmental conditions, and client skill.

7. SAFETY AND CONDUCT

The Client agrees to strictly adhere to all safety protocols. The Outfitter reserves the absolute right to terminate the hunt immediately and without refund if the Client:
•Acts in an unsafe or reckless manner under the influence of alcohol or drugs while hunting
•Refuses to follow instructions
•Attempts to direct or “guide the guide”
Such termination may occur at the sole discretion of the guide.

8. ETHICAL AND ENVIRONMENTAL STANDARDS

Clients must adhere to strict ethical hunting and environmental practices, including:
•Respecting designated property boundaries
•Proper scent control and waste management
•”Pack it in, pack it out” trash policies
•No harassment of wildlife or non-target species
•Violations may result in termination without refund.

9. WEATHER AND FORCE MAJEURE

The Outfitter shall not be liable for delays, modifications, or cancellations caused by weather, acts of nature, government action, or events beyond reasonable control. No refunds will be issued under such circumstances.

10. MEDICAL FITNESS AND INSURANCE

The Client certifies they are physically and mentally fit to participate and strongly recommends obtaining comprehensive travel, medical, and evacuation insurance prior to arrival at their personal expense.

11. MINORS

Any participant under the age of 18 must have written consent and signature from a parent or legal guardian, who assumes full responsibility for the minor’s participation.

12. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Botswana. Any disputes shall be subject to the exclusive jurisdiction of Botswana courts.

13. ENTIRE AGREEMENT

This document constitutes the entire agreement between the parties and supersedes all prior communications. Any amendments must be made in writing and signed by the Outfitter.
By booking and participating, the Client acknowledges acceptance of these Terms and Conditions.
